Once the mediator is chosen and the date is booked, each party will send the mediator a confidential “Mediation Position Statement”. This conveys the facts of the case, advocates for your settlement proposal, and includes any other information you think the mediator should know before the mediation.
The parties should have already exchanged full financial disclosures, such as income, assets, debts, and expenses. This is why it’s important to contact us early so we can establish your situation and prepare your proposal.
The parties will arrive and be located in separate rooms, with the mediator going between rooms to exchange each spouse’s settlement offer. The mediator may offer several creative solutions to a particular problem, depending on what the reservations are. We will be with you to discuss the offers and provide honest feedback to work towards a favorable solution.
If a settlement is reached, the mediator will help draft a written settlement agreement. We will review the agreement with you before finalizing it to ensure the terms are fitting. Once the agreement is signed, it will be filed with the court for the judge to review and approve. If the judge accepts it, the agreement will then be incorporated into the final decree of divorce.

Mediation for complete settlement can take 1-2 days, depending on how many issues need to be resolved or why you are mediating. If a mediation is only meant to settle part of a case, then mediation may only take a day. But if multiple issues need to be resolved, then mediation may take 2-3 days before a final settlement is reached.
If your case is in limbo and your spouse isn’t showing any of their cards, contacting us to get a mediation date on the books can be helpful. This will set a deadline for information exchange, and it will give both parties a sense of the light at the end of the tunnel.
A trial date could be requested, or another day of mediation can be scheduled. But the mediator is likely best suited to telling the parties how to proceed if an agreement cannot be reached through the mediation process.
Regardless of whether the case was entirely resolved, mediation is always helpful because each party leaves with more information than they had when they walked in.
