What Can and Cannot Be Included in a Prenuptial Agreement in Wyoming?

Prenuptial Agreements can address a wide range of topics, including the division of property acquired before and during the marriage, responsibility for debts, alimony, ownership of business interests, estate planning rights, and the management of inheritances and gifts.

Things to Include

Wyoming is an “equitable division” state, meaning that a judge will divide all marital property in a fair, but not necessarily equal, manner.

With this in mind, a prenuptial agreement is one of the best ways to get ahead of any potential disputes regarding asset division. It allows couples to decide on what they want in a divorce by preemptively labeling certain property as “separate” or “joint”.

Prenuptial Agreements allow couples to decide who will be responsible for existing individual debts and how future debts (like mortgages or business loans) will be managed.

It can be intimidating for a couple to share finances if one spouse has a $250,000 graduate student loan while the other has none. While Wyoming law generally provides for this by keeping personal loans separate, the line can be blurred.

A prenuptial agreement would allow these spouses to identify whether they intended to be jointly or individually responsible for debts such as these.

Things Not to Include

There are limits. For example, child support and custody provisions are NOT enforceable in a prenuptial agreement. The rationale is simply that things change. The court makes a determination of custody based on what’s in the children’s best interests at the time of divorce.

Despite their complete unenforceability, some people choose to go ahead and include these provisions anyway. A judge may choose to acknowledge your previous agreement and ask what has changed, but there is no obligation to enforce such provisions whatsoever.

What is a Prenuptial Agreement?

A prenuptial agreement, or a prenup, is a written contractual agreement between two individuals before marriage. An enforceable and effective prenuptial agreement sets forth the soon-to-be-married couple’s terms for how finances will be managed throughout the marriage and how assets and liabilities will be divided in the event of divorce.

Contrary to popular belief, prenuptial agreements are not just for the wealthy. They have become increasingly popular among couples of all backgrounds and financial statuses who want to make informed, mutually beneficial financial decisions ahead of time.

Having a prenuptial agreement is one of the best ways to avoid prolonged litigation and ensure a predictable outcome in case of divorce.

Wyoming Prenuptial Agreement Laws

The state of Wyoming follows the Uniform Premarital Agreement Act (“UPAA”), which sets the standard for enforceability and fairness in prenuptial agreements.

Under the UPAA, prenuptial agreements must be in writing and signed by both parties. Both parties must fully disclose their assets and debts. The agreement may be voidable if significant omissions occur.

The general idea is to ensure that each spouse has a complete understanding of the other’s financial situation, so that an agreement as to the division of assets and liabilities in the event of divorce is entered into in good faith.
Prenuptial agreements become effective upon marriage. This means that the agreement is not enforceable until you are legally married, no matter how far in advance it is signed.
